Privacy Notice for Clinical Collaborators and Healthcare Professionals

Immunovant and its respective subsidiaries and affiliates (“Immunovant”, “we”, “us”, or “our”) recognizes the importance of protecting your privacy. This Privacy Notice (“Notice”) explains how we collect, use and disclose information in connection with the use of personal details of clinical collaborators and healthcare professionals with whom we work with, or wish to work with, during a clinical study or to plan future studies. Immunovant is the Data Controller for the processing of personal information as described in this Notice.

Any changes will be posted here and you should check this page periodically for updates. If we make material changes to this Notice, we will provide you with notice as required by law.

Please note, you may also be subject to another Privacy Notice or other terms and conditions specific to a particular Immunovant program, service or study (“Other Agreement”). Based upon your specific relationship(s) with Immunovant, we may collect, use or disclose your information in ways described in more detail in one or more Other Agreements. To the extent the Other Agreement includes additional terms that are not covered by or are inconsistent with this Notice, the terms and conditions of the Other Agreement will supersede this Notice.

Information We Collect

We may collect a range of different types of information about you. We always make sure to only collect the minimum amount of information required to fulfil our purposes. What personal information we collect will depend upon how you interact with us. 

We collect and store the following information when:

  • You submit information requests, business proposals, employment inquiries, and responses to surveys on our Website
  • You contact us by phone or email
  • We receive information about you from business partners, third parties, affiliates and publicly available information

The information we process about you may include: full name, home address, phone number, e-mail address, qualifications, curriculum vitae, employment history, research interests, professional memberships, your answers to background information questions, your responses to surveys and questionnaires.

Where we engage with you to work with us, we may also collect information relating to your bank details if we are paying your directly for your services.

When we first collect information about you from a source other than yourself, we will communicate with you within one calendar month of collecting the data to provide this privacy information and to give you the chance to opt out of us processing your data any further.

How We Use Your Information

Immunovant processes your personal information for a number of different purposes. For each purpose, in accordance with UK and EU law (if applicable), we have identified a lawful basis for processing. 

Legitimate Interests – We process individuals’ personal information in pursuit of our legitimate interests to:

  • maintain databases of professionals working in areas of interest related to our research;
  • to contact relevant professionals with a view to future collaboration;
  • maintain our relationship with you – communicate with you and answer your queries;
  • ask the relevant professionals and institutions if they wish to participate in potential clinical trials;
  • ask you to participate in brief surveys;
  • for the purpose of researching and developing new medicines and designing studies;
  • to invite you to academic, scientific and promotional meetings, events and seminars linked to your medical expertise;
  • to allow us to assess and validate your professional expertise, competence and suitability for conducting and/or being involved in the clinical trial;
  • to support applications for approval of the product under investigation;
  • for internal reporting and management of resources.

Contract – We process individuals’ personal information in order to enter into a contract with them:

  • to maintain a professional relationship with you;
  • To allow and document the distribution of product samples to you;
  • to pay your for your services and expenses;
  • managing your participation in one of our Studies.

Legal Obligation – We may process your personal information in accordance with our legal obligations where you are involved with one of our studies:

  • to ensure that the professionals hold appropriate qualifications and professional memberships to be involved with a clinical trial and verify that you meet specific regulatory criteria.

Consent – We may process your personal information only where you have consented to us doing so. Where we rely on your consent, you have the right to withdraw this at any time:

  • to collect ethnicity information for equality, diversity and inclusion purposes (only where we are required to do so)
  • (In some countries where consent is required) to manage our relationship with you as a HCP

We also collect, use and share aggregated data for various purposes. For example, your website usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your Personal information so that it can directly or indirectly identify you, we treat the combined data as Personal information which will be used in accordance with this Notice.

Please note that, based upon your specific relationship(s) with Immunovant, we may use your information in ways described in more detail in one or more Other Agreements.

Disclosure of Your Information

We may disclose your information to certain third parties with whom we have a direct or indirect business or contract relationship, under the following circumstances:

To our subsidiaries or affiliates:

We may disclose your information to other companies within the Immunovant family of companies.

To service providers:

We disclose your information with third parties who perform services on our behalf, including without limitation market research, data storage, data analysis and processing, and legal services.

To protect ourselves or others:

We may also disclose information collected in accordance with applicable law, to assert or defend our rights and property, to prevent harm to others, to collect a debt, or in response to legal processes such as subpoenas.

To comply with the law:

We may also provide (or reserve the right to provide) information to regulators, law enforcement authorities, courts, and other governmental authorities, consistent with applicable laws.

For organizational transfers:

As we continue to develop our organization, we may acquire, merge or partner with other organizations. In such transactions, (including in contemplation of such transactions, e.g., due diligence) user information may be among the transferred assets. If any of Immunovant’s assets are sold or transferred to a third party, customer information (such as your email address) would likely be one of the transferred business assets.

International cross-border data transfers

Because Immunovant operates globally, your data may be transferred outside of the country in which you interact with Immunovant, including to countries whose data protection laws substantially differ from the country in which you work or reside and may not provide the same level of data protection as in your country of residence. To accomplish the purposes described in this Notice, we may also disclose and transfer Personal information to personnel and other departments throughout Immunovant, or to service providers and/or collaborators, licensees and strategic partners based overseas, to the extent that your Personal information is shared with service providers, Immunovant affiliates or other third parties processing Personal information on our behalf, which are located outside your country of residence.

For example, your Personal information may be transferred or accessed by Immunovant and its affiliate entities in the United States of America.

Immunovant shall seek to maintain confidentiality as required within the limits of local laws in these countries.

If you are located in the UK or EU and we are required to transfer your Personal information out of the UK or EU, we ensure that at least one of the following safeguards is implemented:

  • transferring your Personal information to countries that have been deemed to provide an adequate level of protection for Personal information by the relevant authority.
  • using specific contracts approved which give Personal information the same protection it has in Europe including standard data protection clauses approved by the European Commission and/or the UK government providing adequate protection of Personal information.

Data Retention

The period of time for which we retain your personal information will depend upon how you interact with us. To determine the appropriate retention period for Personal information, we consider the amount, nature and sensitivity of the Personal information, the potential risk of harm from unauthorised use or disclosure of your Personal information, the purposes for which we process your Personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

Where we do not have a reason or legal obligation to retain your Personal information, it will be deleted in accordance with our Retention Policy.

Where you have worked with us on a clinical trial, we will retain your personal information for a period of up to 25 years after the completion of the clinical trial as required by applicable clinical trial legislation. Where we have interacted with you in another way, we will store your information unless you tell us otherwise, or until we believe you are no longer active in our field of research.  

Your Rights

Depending upon where you are located, you may have some or all of the following rights in relation to your Personal information:  



  • ask for access to your Personal information via a 'subject access request'; 
  • ask for Personal information we hold about you to be corrected; 
  • ask for your Personal information to be deleted. This enables you to ask us to delete or remove your Personal information where there is no good reason for us continuing to process it; 
  • object to the processing of your Personal information where we are relying on a legitimate interest, and there is something about your particular situation which makes you want to object to processing it; 
  • ask for the processing of your Personal information to be restricted. This enables you to ask us to suspend the processing of Personal information about you; and 
  • ask for your Personal information to be transferred to another company. 

You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making unless we have a lawful basis for doing so and we have notified you.

Security

Immunovant will implement appropriate technical and organizational security measures necessary to adequately safeguard your Personal information. These safeguards will include, for example:

Security Measures

  • Access to Personal information is restricted and provided only where necessary, to those employees, agents, contractors and other third parties who have a business need-to-know.
  • All employees handling Personal information receive security and data protection awareness training, will only process your Personal information on our instructions and are subject to a duty of confidentiality.
  • Employees with access to Personal information are given the least privilege required.
  • We have robust procedures in place to deal with any suspected Personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
  • A disciplinary policy is enforced to prevent unauthorised access.
  • Where technically feasible, data is encrypted in transit and at rest.
